Welcome to Carly The Dog! These Terms of Service ("Terms") govern your access to and use of the Carly The Dog mobile application ("App", "Service", "we", "our", or "us"). Please read these Terms carefully before using the App.

By downloading, installing, or using Carly The Dog, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Carly The Dog is a mobile application that uses artificial intelligence to analyze photographs of dogs and provide estimated age ranges and breed identification. The App is designed for informational and entertainment purposes only.

2. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. User Responsibilities

By using Carly The Dog, you agree to:

• Use the App only for its intended purpose of dog age and breed estimation
• Provide photos only of dogs you own or have permission to photograph
• Not attempt to reverse engineer, modify, or tamper with the App
• Not use the App for any illegal or unauthorized purpose
• Not attempt to circumvent any usage limits or security measures
• Comply with all applicable laws and regulations

4. AI Estimates Disclaimer

IMPORTANT: The age and breed estimates provided by Carly The Dog are generated by artificial intelligence and are intended for informational and entertainment purposes only.

• Estimates are NOT veterinary advice, diagnosis, or medical opinions
• Estimates should NOT be used as a substitute for professional veterinary consultation
• Accuracy may vary based on photo quality, lighting, dog breed, and other factors
• We make no guarantees regarding the accuracy or reliability of any estimates
• Always consult a licensed veterinarian for accurate age assessment and health advice

5. Usage Limits

The App currently provides 20 AI estimates per rolling 30-day period at no cost. Each estimate slot refreshes 30 days after it was used. We reserve the right to modify these limits at any time with or without notice.

6. Free Service and Pricing Changes

Carly The Dog is currently offered as a free service. However, we reserve the right to:

• Introduce paid features or premium subscriptions
• Modify or reduce free tier limitations
• Implement usage-based pricing
• Discontinue the free service at any time

We will make reasonable efforts to notify users of significant pricing changes through the App or our website.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Carly The Dog or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any photos you submit through the App. By submitting photos, you grant us a limited, non-exclusive license to process those photos solely for the purpose of providing the age and breed estimation service.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of estimates
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the results obtained from using the App

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARLY THE DOG, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages resulting from your reliance on AI-generated estimates
• Any damages resulting from unauthorized access to or alteration of your data
• Any damages exceeding the amount you paid to use the App (if any)

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Carly The Dog, its developers, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit through the App

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

You may stop using the App at any time by uninstalling it from your device.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms within the App or on our website with a new "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Carly The Dog regarding your use of the App and supersede any prior agreements or understandings.
